This Privacy Policy describes how Moto Club Hub ("We", "Us", "Our") collects, uses, shares and protects Your information when You use the Service, and explains Your privacy rights and how the law protects You.

We use Your personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy. The information described here is also reflected in our App Store and Google Play privacy disclosures.

Summary

In short:

  • We collect the information you give us (such as your account and profile, your motorcycles, documents, meet ups and routes) and some information automatically (such as device and usage data).
  • We use location only while you are actively using a location feature, and only in the foreground.
  • We rely on a small number of trusted providers (Google Firebase, RevenueCat, Sentry and Stadia Maps) to run the Service.
  • We do not sell your personal information and we do not show third-party advertising.
  • You can edit your content and delete your account in the app, and you have rights over your data, including the right to complain to a data protection authority.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Application refers to Moto Club Hub, the software program provided by the Company.
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Privacy Policy) refers to Moto Club Hub, based in Ireland.
  • Country refers to Ireland.
  • Device means any device that can access the Service, such as a computer, a cellphone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the Application.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate or provide the Service on its behalf.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself.
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Information We Collect

Information You Provide to Us

  • Account Information: Your name or chosen display name, email address, and password. If you sign in with Google or Apple, We receive basic profile information from them, such as your name, email address and a unique identifier, in line with the permissions you grant.
  • Profile Information: Your user handle (@username), "about" text, country, phone number, and any profile picture or cover photo you upload.
  • Vehicle Information: Details about your motorcycles in your garage, such as make, model, VIN and registration plate, and any photos you add.
  • Identity and Documents: Identification, licences and documents you choose to store, including any photos or files you upload. These are stored for your own convenience, are private to your account, and are not a substitute for carrying valid physical documents (see our Disclaimer).
  • User-Generated Content: Content you create, such as meet ups (names, descriptions, locations and times), routes (Spins), comments on meet ups, routes and cafés, and any images, cover photos or flyers you add.
  • Friends and Connections: Your friend connections, friend requests, and any users you block.
  • Communications: Information you provide when you contact us for support or use the in-app feedback feature, which may include a screenshot and basic device information you choose to send.

Information Collected Automatically (Usage Data)

When you use the Service, We collect certain information automatically, including your Device's IP address, device type and unique device identifiers, operating system, the features and pages you use, the date, time and duration of your activity, and other diagnostic data.

To deliver push notifications, We also collect a push notification token associated with your Device.

We also collect:

  • Device-integrity signals: to protect accounts and prevent abuse, We check whether your Device appears to be rooted, jailbroken or otherwise compromised.
  • Consent records: We keep a record of the consents you give, including your agreement to this Policy and your confirmation that you are 18 or older, together with their version and date.
  • In-app message status: where We send you in-app messages or announcements, We record whether you have read them.

Location Data

Location is used only while you are actively using a relevant feature, and only in the foreground. We do not track your location in the background. Location is used for:

  • Map display: your approximate location is used to centre the map on your area.
  • Meet ups and routes: the locations you set when you create a meet up, and the geographic points that make up a route (Spin), are stored as part of that content.
  • Venue check-ins: when you check in at a participating venue, We record the check-in (including the venue and time).

Rider Safety Features (Live Location and Distress Signal)

The Service includes optional rider-safety features that use Your real-time location. They operate only while you choose to use them, and only in the foreground.

  • Live location sharing: When you turn on live location sharing during a meet up, your real-time location is shared with the other attendees of that meet up so the group can see where you are. You control when sharing is on and can stop it at any time. The shared location is automatically deleted shortly after the meet up ends (within approximately 30 minutes).
  • Distress signal: When you send a distress signal, your location and an alert are shared with other nearby users of the Service so that they may come to your assistance. This feature depends on other users, connectivity and your device, and does not guarantee a response. It is not an emergency service and does not contact the emergency services. In an emergency, always call your local emergency number directly (see our Disclaimer).

We do not use this safety location data for advertising or profiling, and We do not share it with anyone other than the users you are sharing with and the Service Providers that host the Service on Our behalf.

Parking Location ("Where Did I Park?")

The Application includes an optional "Where Did I Park?" feature that lets You save the location of Your parked vehicle and, if You choose, share it temporarily with another signed-in user. This feature only collects location data when You actively use it.

When You save a parking spot, We collect the geographic coordinates of the spot, a reverse-geocoded postal address derived from those coordinates, and the date and time it was saved. Your saved parking spot is private to Your account and is kept until You clear it or delete Your account.

If You choose to share Your parking spot, We create a separate share record (including Your display name, profile photo, the parking location and an expiry time) so the recipient can find Your vehicle. A shared link can only be opened by a signed-in user, and automatically expires 24 hours after it is created or last refreshed, after which the share record is deleted.

How We Use Your Personal Data

The Company may use personal data to:

  • Provide and maintain the Service, including to operate its features and monitor usage.
  • Manage Your Account and your registration as a user.
  • Operate safety features, such as live location sharing and the distress signal, at your request.
  • Process subscriptions purchased through the App Store or Google Play.
  • Contact You with service-related communications and push notifications about meet ups you follow, friend requests, and important updates.
  • Moderate content and prevent abuse, including reviewing reported content and enforcing our policies.
  • Analyse and improve the Service, including diagnosing crashes and understanding usage trends.
  • Comply with legal obligations and respond to lawful requests.

If We send You optional updates or promotional messages, You can opt out at any time using the unsubscribe option in the message or by contacting Us. Service-related communications, such as security and account notices, are necessary to provide the Service and cannot be opted out of.

How We Share Your Personal Data

We may share your personal information:

  • With other users: Content you post in public areas (such as public meet ups, comments and your public profile) is visible to other users. When you use live location sharing, your location is shared with meet-up attendees; when you send a distress signal, it is shared with nearby users.
  • With Service Providers: the third-party processors listed below, who act on Our behalf.
  • With Affiliates: with companies under common control with Us, who are required to honour this Privacy Policy.
  • With business partners: where you take part in a promotion or offer run with one of Our business partners, to the extent needed to provide it.
  • For legal reasons: to comply with the law, respond to lawful requests, protect the rights, safety and property of Our users or the public, and prevent or investigate wrongdoing.
  • Business transfers: in connection with a merger, acquisition or sale of assets, in which case We will provide notice.
  • With Your consent: for any other purpose you agree to.

We do not sell your personal information. We do not show third-party advertising in the Service, and We do not use your personal data for advertising or to track you across other apps or websites.

Disclosure of Your Personal Data

Business Transactions

If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement and Other Legal Requirements

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (for example, a court or a government agency). The Company may also disclose Your Personal Data in the good-faith belief that such action is necessary to:

  • Comply with a legal obligation;
  • Protect and defend the rights or property of the Company;
  • Prevent or investigate possible wrongdoing in connection with the Service;
  • Protect the personal safety of users of the Service or the public; and
  • Protect against legal liability.

Third-Party Service Providers

We use the following providers, who act as data processors and have their own privacy policies:

  • Google Firebase: authentication, database (Firestore), file storage (Cloud Storage), push notifications (Cloud Messaging), Remote Config, abuse protection (App Check), performance monitoring (Firebase Performance), and analytics (Firebase Analytics). Google's Privacy Policy
  • RevenueCat: manages subscriptions and entitlements. It receives an anonymous user identifier and subscription status; it does not receive Your name, email or payment details, which remain with the App Store or Google Play. RevenueCat's Privacy Policy
  • Sentry: crash reporting, error tracking and performance monitoring. Sentry's Privacy Policy
  • Stadia Maps: provides our map tiles. When the app displays a map, it requests tiles from Stadia Maps, which receives Your Device's IP address and the map area being viewed. Stadia Maps' Privacy Policy

Lawful Basis for Processing

Where the EU or UK General Data Protection Regulation applies, We process Your personal data on the following legal bases:

  • Performance of a contract: to provide the Service, manage Your account, and process subscriptions.
  • Legitimate interests: to operate analytics, monitor for crashes and errors, prevent fraud and abuse, and improve the Service. You may object to this processing at any time.
  • Consent: for optional features that ask for your explicit agreement at the point of use (for example, location-based and safety features). You may withdraw consent at any time.
  • Legal obligation: where We are required to retain or disclose data to comply with applicable law.

Your Rights and Choices

Depending on where you live, you have rights over your personal data. Under the EU/UK GDPR these include the right to:

  • Access the personal data We hold about you and request a copy.
  • Rectify inaccurate or incomplete data.
  • Erase your data ("right to be forgotten").
  • Restrict or object to certain processing.
  • Data portability: receive your data in a portable format.
  • Withdraw consent at any time, where processing is based on consent.

You can exercise many of these directly in the app: you can edit your profile and content, and delete your account and associated personal data from the account settings screen (your data is then removed within 30 days). To make any other request, contact us at motoclubhub@mod72.com.

You also have the right to lodge a complaint with a supervisory authority. In Ireland, this is the Data Protection Commission (dataprotection.ie).

Data Retention

We keep personal data only for as long as necessary for the purposes described in this Policy:

  • Account and profile data, garage, documents and saved content are kept until you delete them or delete your account; on account deletion they are removed within 30 days.
  • Live location shared during a meet up is deleted automatically shortly after the meet up ends (within approximately 30 minutes).
  • Parking shares expire automatically 24 hours after they are created or last refreshed and are then deleted.
  • Past meet ups are removed automatically about 31 days after they end.
  • Venue check-ins are removed automatically after about 30 days.
  • Usage and analytics data is retained for a limited period in line with our analytics provider's retention settings, and crash and error data for a limited period by our crash-reporting provider.

We may retain certain information for longer where We have a legal obligation or other lawful basis to do so.

International Data Transfers

Your information may be processed and stored on servers located outside your country, including in the United States, where some of our Service Providers operate. Where personal data is transferred outside the EEA or UK, We rely on appropriate safeguards, such as the European Commission's Standard Contractual Clauses, to protect your data. We will not transfer Your Personal Data to a country or organisation unless there are adequate controls in place, including the security of Your data and other personal information. By using the Service, you consent to such transfers.

Security of Your Personal Data

We take reasonable measures to protect your data, including encryption in transit, access controls so that private data (such as your documents and parking spots) is accessible only to you, and abuse protection (App Check) on our backend. We also check for rooted, jailbroken or otherwise compromised devices, which pose a security risk to your account. If you enable App Lock, sensitive screens require your device's biometrics or passcode; this is handled entirely by your device, and We do not receive your biometric data. You are responsible for keeping your account credentials confidential and for choosing a strong, unique password. However, no method of transmission or storage is 100% secure, and We cannot guarantee absolute security.

Children's Privacy

The Service is intended for adults and does not address anyone under the age of 18. We do not knowingly collect personal data from anyone under 18. If You become aware that a child has provided Us with personal data, please contact Us, and We will take steps to remove it. See our Child Safety Standards Policy.

California Privacy Rights (CCPA/CPRA)

In the past 12 months We have collected the following categories of personal information: identifiers (such as name, email, user handle, device identifiers and IP address); account and profile information; commercial information (such as your subscription status); internet and app activity (usage data); geolocation data; audio-visual information (photos and files you upload); and user-generated content. We collect this for the purposes described in this Policy and disclose it only to the service providers and in the situations described above.

If you are a California resident, you have the right to:

  • Know what categories of personal information We collect, the purposes for collecting it, and the categories of third parties with whom We share it (all described in this Policy).
  • Access a copy of the personal information We hold about you.
  • Delete your personal information.
  • Correct inaccurate personal information.
  • Opt out of the "sale" or "sharing" of personal information. We do not sell or share your personal information as those terms are defined under California law.
  • Non-discrimination: We will not discriminate against you for exercising these rights.

Cookies and Local Storage

The Application stores data locally on Your Device, such as your preferences, your consent choice, and cached content, so the app can function and work offline. Our website may use a small number of essential cookies. We do not use cookies or local storage for third-party advertising.

Aggregated and De-identified Data

We may create aggregated or de-identified data that cannot reasonably be used to identify You. We may use such data for any purpose, including analysing usage and improving the Service.

Do Not Track and Global Privacy Control

The Service does not track You across third-party apps or websites. Because We do not carry out such cross-context tracking, the Service does not respond differently to "Do Not Track" or Global Privacy Control signals. We honour applicable privacy choices and opt-out rights as described in this Policy.

Links to Other Websites

Our Service may contain links to other websites that are not operated by Us. We have no control over, and assume no responsibility for, the content or privacy practices of any third-party sites. We advise You to review the privacy policy of every site You visit.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date, and, where appropriate, by email or a prominent in-app notice before the change takes effect.
